Regulations

The following Regulations define the general terms and conditions of sales applicable in our online shop available at www.gofashiondesigner.com, run by Grażyna Osiecka-Jaśkiewicz, Szczęśliwicka 68/5, Warsaw 02-353, NIP: 8121267025, REGON: 146933230. The business activity is registered in the Central Register and Information on Business Activity (CEIDG), run by the Minister responsible for economy.

1. SCOPE OF THE RULES

The terms and conditions apply to all orders placed via our online shop. The offer of our online shop is exclusively for consumers.

A consumer is, in accordance with Article 22 of the Civil Code, a natural person making a legal transaction with an entrepreneur which is not directly related to his/her economic or professional activity.

2. CONCLUSION OF THE AGREEMENT

The sales contract is concluded with Grażyna Osiecka-Jaśkiewicz.

The presentation of products in our online shop constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code. In order to make an offer to purchase the products, you must place an order. Using the mechanisms available in our shop, you can add the products of your choice to the shopping basket and make an offer to purchase. The shopping basket and the data you enter in the forms can be modified before you place your order using the available functionalities and messages displayed during the ordering process. By clicking on the confirm and finalise button on the order summary page, you place an order for the products in the shopping basket.

Once your order has been placed, you will receive an automatically generated e-mail from the system confirming the registration of your order and your choice of payment method This e-mail is not tantamount to a statement of acceptance of your offer and the conclusion of the sales contract. The contract of sale is concluded after verification that the order can be accepted for fulfilment and acceptance of your offer, which takes place via a separate e-mail message stating that the order has been approved for fulfilment. As soon as you receive such a statement, the sales contract is concluded.

3. LANGUAGE AND RULES FOR RECORDING THE AGREEMENT

The sales contract may be concluded in the Polish language.

The content of the contract is not recorded by us.

4. DELIVERY OF PRODUCTS

Ordered products are delivered via courier companies cooperating with us. You will find detailed information in this respect during the ordering process and in the special information section on our shop website.

The products offered in the shop are sold exclusively by mail order. It is also possible to collect them in person at the Atelier in Warsaw at 4 Opaczewska Street.

We do not send fur products to parcel post.

5. PAYMENTS

The following forms of payment are available to you in our online shop:

 * Electronic payments (e-payments) via an online payment service.

 * Payment by traditional bank transfer to our shop's bank account. If you choose this form of payment - we will send you, via e-mail, the details for the transfer after your order has been placed. The processing of your order will be commenced after the full amount of the required payment for your order has been credited to our account.

Detailed information on the possible methods of payment, including the online payment services integrated into our shop and the types of e-payment available, as well as possible additional costs, is presented during the ordering process and on our shop's website in a special information section on payment methods.

6. RIGHT OF WITHDRAWAL

Consumers have a statutory right of withdrawal of 14 days ( from the day of receipt of the parcel from the shop), as stated in the instructions on the right of withdrawal. Natural persons concluding a contract directly related to their business activity shall also have the right to withdraw from the contract, when it follows from the content of the contract that it does not have a professional character for these persons within the meaning of Article 556 (4) of the Civil Code.

7. WARRANTY, GUARANTEE AND SELLER'S LIABILITY

We are obliged to deliver products (items) free of defects. The statutory right of liability for defects of the thing sold (so-called warranty for defects) shall apply to the extent set out in Article 556 et seq. of the Civil Code.

We undertake to respond to the complaint immediately, but no later than within 14 days of its submission. In the event of exercising warranty rights, if we consider it necessary to resolve the complaint, you are obliged to deliver the defective item at our expense to the above-mentioned postal address

8. ELECTRONICALLY SUPPLIED SERVICES

In order to use our online shop, including browsing our product range and placing orders, it is necessary to have a multimedia device with a web browser installed and access to the Internet and email. It is recommended that you enable JavaScript and the storage of cookies in your browser settings. Users are obliged to use the web shop in a manner consistent with the law and good morals, and it is prohibited to provide content of an unlawful nature.

We take all necessary measures to ensure that the website and the interface of our online shop are fully functional to the extent of our current technical knowledge, and we undertake to remove any irregularities and technical problems reported by users within a reasonable period of time. The above applies to the possibility of creating a customer account You may notify us of any detected irregularities or interruptions in the functioning of the website and the services of our online shop via the contact details indicated in the paragraph above. In complaints regarding irregularities in the technical functioning of the web shop service, please indicate the type and date of the irregularity.

9. OUT-OF-COURT DISPUTE RESOLUTION

We would like to inform you that Consumers have the possibility to use the out-of-court complaint and redress procedure. The ODR platform is a multilingual, interactive website for serving Consumers and traders seeking out-of-court resolution of disputes arising from the conclusion of a distance sales or service contract.

The use of the aforementioned out-of-court means of redress and dispute resolution is voluntary and can only take place if both parties to the dispute (the consumer and the seller) agree to it.

Nothing in these Terms and Conditions is intended to infringe the statutory rights of Consumers. In the event of any contradiction between the provisions of these Terms and Conditions and the rights of Consumers arising from universally applicable regulations - the statutory regulations shall always apply in place of the contested provisions of the Terms and Conditions.
